Arlington, VA – Yesterday’s unanimous decision by the Federal Circuit Court in Cincinnati puts a stop to the FCC’s more recent attempt to reclassify broadband services from an information service to a public utility-like service, subject to onerous regulations. That decision will end, for now, the potential cascade of regulatory costs that would have foreclosed innovative business opportunities in information technologies, reduced broadband growth, increased consumer prices, and discouraged new investment in network infrastructure. To quote the American Consumer Institute’s Nate Scherer, “This week’s decision is a win for consumers. The internet is not broken and certainly does not need top-down, utility-style regulations. Consumers already enjoy a wide range of benefits including faster and more widely available internet service at declining prices. This decision will help safeguard these benefits for years to come.”
