The American Consumer Institute (ACI) submitted comments to the Office of Science and Technology Policy (OSTP) regarding the development of an Artificial Intelligence (AI) Action Plan. ACI emphasizes the importance of maintaining American leadership in AI by reducing regulatory burdens and promoting market-driven innovation. Key points from the comments include:

  1. Pro-Freedom AI Leadership: ACI argues that excessive compliance costs threaten AI innovation and urges OSTP to adopt a light-touch regulatory approach. We support the creation of a federal AI sandbox and a clear separation between AI and data privacy regulations.
  2. Algorithmic Bias Regulation: ACI contends that the private sector is already addressing AI bias effectively, citing efforts by major tech firms. We warn against regulatory overreach and suggests benchmarking AI bias mitigation against human decision-making rather than unrealistic error-free standards.
  3. Voluntary AI Risk Management Framework (RMF):ACI supports keeping the NIST AI RMF voluntary and flexible, rather than making it a de facto regulatory requirement. However, we also call for a revised, more concrete framework that evolves naturally over time.
  4. Federal Data Accessibility: ACI advocates for improved access to de-identified federal datasets to support AI training, particularly for startups and small businesses.
  5. Federal Data Privacy Framework: ACI calls for a federal privacy framework to pre-empt the growing patchwork of state laws that complicate AI development. The organization stresses the need for a clear, narrowly tailored federal standard that supports innovation while protecting consumer data.
