Statement: Support for the SECURE Data Act

Arlington, VA-Building on the American Consumer Institute’s (ACI) previous research and policy papers, ACI has long supported efforts like the SECURE Data Act as a way to address the inefficiencies of America’s fragmented data privacy landscape. In earlier work ACI has emphasized the need for a unified, flexible approach that prioritizes consumers while allowing innovation to evolve. Against this backdrop, the SECURE Data Act reflects many of the principles ACI has consistently advanced in its push for a more coherent national data privacy framework.

“The American Consumer Institute has warned policymakers for years that America’s splintering, uncoordinated approach to data privacy has exposed consumers to high costs and unintended harms. By looking to the states for lessons on what has—and has not—worked, the SECURE Data Act builds a commendable framework that keeps consumers at the heart of data privacy policy. ACI is especially encouraged by the decision to include a “rebuttable presumption” for businesses that opt-in to vetted, voluntary third-party codes of conduct. That novel, flexible improvement echoes in spirit ACI’s recent recommendations for pragmatic, incentive-based tools that allow privacy practices to evolve and adapt to changing consumer-focused privacy norms.”
