Arlington, VA-The American Consumer Institute (ACI) submitted public comments urging the Food and Drug Administration (FDA) to revise its draft guidance on flavored electronic nicotine delivery systems (ENDS) to better reflect scientific evidence and consumer behavior. The comments argue that flavored vaping products, particularly sweet and fruit flavors preferred by adults, play a critical role in helping smokers quit combustible cigarettes and should not be presumed to target youth. ACI emphasized that youth nicotine use has declined significantly in recent years despite the continued availability of flavored products, suggesting that enforcement and age restrictions—not flavor bans—are more effective at reducing underage use.
ACI called on the FDA to adopt a balanced regulatory framework that recognizes the reduced harm of vaping compared to smoking while maintaining strict safeguards to prevent youth access.
