Public Comments: ACI Technology Policy Director Submits Testimony Warning of New Hampshire’s Digital Choice Act

Arlington, VA-Logan Kolas, Director of Technology Policy at the American Consumer Institute, submitted written testimony warning that New Hampshire House Bill 1589 risks importing deeply flawed data interoperability mandates that threaten consumer privacy.

While New Hampshire should be applauded for engaging seriously with data privacy protections, HB 1589 goes beyond established norms by allowing access to other users’ data without their consent—a step even the European Union avoids. Kolas urged lawmakers to reject these privacy-invasive provisions, noting that interoperability should emerge organically through market standards, not through mandates that expose consumers to unnecessary harm.
