Coalition Letter: ACI Urges Congress to Use CRA to Overturn California’s EPA Clean Air Act Waivers

Arlington, VA-The American Consumer Institute (ACI) has joined a coalition urging Congress to use the Congressional Review Act (CRA) to overturn several EPA Clean Air Act waivers granted to California, These waivers let California set de facto national rules for vehicles, small engines, and maritime equipment. The letter supports House and Senate resolutions targeting waivers for 2009 GHG vehicle standards, Advanced Clean Cars I, its 2022 reinstatement, small off‑road engines, at‑berth vessel rules, and commercial harbor craft.

The waivers raise costs, limit consumer choice, and exceed the intended scope of California’s authority. CRA disapproval would also block EPA from issuing “substantially the same” waivers in the future. Support for these resolutions is support for federalism and consumer freedom.
